These Terms of Use (“Terms”) govern your access to and use of BarbellBae’s websites, mobile applications, and related services (the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated by reference.

1. Eligibility

You may use the Service only if all of the following are true:

  • You are a natural person (not a corporation or other entity) and you are at least 18 years of age.
  • You have the legal capacity to enter a binding contract where you live.
  • You are not prohibited from using the Service under applicable law.
  • You will comply with these Terms and all applicable laws.

The Service is for adults only. We do not permit accounts for anyone under 18. If you no longer meet these requirements, you must stop using the Service and delete your account.

2. Your account

You are responsible for your account credentials and for activity under your account. Provide accurate profile information and keep it updated. You may not share your account with others or create multiple accounts to evade enforcement of these Terms.

3. Community standards

You agree not to:

  • Harass, threaten, defraud, stalk, or harm other users on or off the Service.
  • Post content that is illegal, hateful, excessively violent, or sexually explicit in a way that violates our community norms or applicable law.
  • Impersonate any person or misrepresent your age, identity, or affiliation.
  • Scrape, crawl, reverse engineer, or use automated means to access the Service without our prior written consent.
  • Upload malware or attempt to disrupt or gain unauthorized access to our systems or other users’ accounts.
  • Use the Service for spam, pyramid schemes, illegal solicitation, or non-personal commercial solicitation without authorization.
  • Circumvent safety features, reporting tools, or enforcement actions.

We may investigate reports, remove content, suspend or terminate accounts, and cooperate with law enforcement when appropriate.

4. Content

You retain ownership of content you submit. You grant BarbellBae a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute your content solely to operate, promote, and improve the Service and as described in our Privacy Policy. You represent that you have the rights to grant this license. Other users’ content belongs to them; you may not copy or exploit it outside what the Service allows for personal interaction.

5. Fees

Some features may be paid. Prices and billing terms will be presented at purchase. Unless required by law or stated otherwise at purchase, fees are non-refundable. Subscriptions renew as disclosed at signup; you may cancel as described in the purchase flow or your app store settings.

6. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARBELLBAE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS; BARBELLBAE IS NOT A PARTY TO OFF-SERVICE MEETINGS OR RELATIONSHIPS.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARBELLBAE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.

8. Indemnity

You will defend, indemnify, and hold harmless BarbellBae from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

9. Termination

You may stop using the Service and delete your account at any time (where the product allows). We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive will survive termination.

10. Governing law and disputes

These Terms are governed by applicable law without regard to conflict-of-law rules. Courts in the jurisdiction where BarbellBae primarily operates may have exclusive jurisdiction, unless mandatory consumer protections in your country require otherwise.

11. Changes

We may modify these Terms. We will post the updated Terms and update the effective date. Continued use after the effective date of material changes may constitute acceptance, where permitted by law. If you do not agree, you must stop using the Service.
